1. About these terms

InstaSights is operated by Simsurveys, LLC, an Illinois limited liability company ("we," "us," or "our"). These Terms of Service govern your use of the InstaSights website and research application (the "Services"). By accepting these terms, creating an account, or using the Services, you agree to them. If you do not agree, do not use the Services.

If you use InstaSights on behalf of a business, you must have authority to accept these terms for that business. A separate written agreement may supersede these terms for an Enterprise or negotiated engagement.

2. Your account

Provide accurate registration information and keep it up to date. You are responsible for protecting your account credentials and for activity under your account. Do not share credentials with unauthorized parties.

You may prepare a study before purchasing it. Running a paid study requires the applicable purchase or an available study credit.

3. Research and appropriate use

InstaSights helps you describe a research question, review an audience and questionnaire, generate simulated consumer responses, and inspect or download results. Review the proposed setup before running your study.

Generated responses are synthetic, not answers collected from people recruited for your study. Research results and any accuracy measures are informational. We do not guarantee their accuracy or completeness, or that they predict actual purchases, individual behavior, or future market outcomes.

The Services are for research and marketing research. Do not use generated data for clinical decisions, patient care, or any use that could affect health outcomes.

Do not use the Services unlawfully, attempt to reverse engineer or extract the platform’s models, algorithms, or source code, or abuse study credits and refinement runs. We may deny credits or refinements in cases of abuse.

4. Your content and study outputs

You must have the necessary rights, permissions, and authority to submit your research material. Information about other people must be properly de-identified, or you must have the rights and consents needed for us to process it as described in these terms and our Privacy Policy.

We retain our rights in the Services, software, models, and algorithms. Third-party technology remains subject to its owners’ rights.

You receive an exclusive, non-transferable license to use your generated questionnaires, synthetic data, and reports for your business purposes, including selling or delivering those outputs to your clients. Ownership of the outputs remains with us.

If a separate engagement includes a custom model built from your training data, you retain ownership of that raw data. We own the resulting models and enhancements, and grant you an exclusive license to use the custom model within the platform. Model weights and learnings may be incorporated into our general modeling framework, unless a separate written agreement states otherwise.

5. Plans, payments, and study credits

The available offers are described on our pricing page. Review the selected plan, amount, billing interval, and any applicable taxes at checkout before authorizing payment. Prices are in US dollars. Enterprise scope and pricing are agreed separately.

A single-study purchase does not create a subscription, and its study credit does not expire. Monthly subscriptions renew and are billed each month until canceled. Unused monthly study credits do not roll over. Manage your subscription through your account’s billing settings.

Your subscription and checkout confirmation identify the terms of your purchase. A change to the offers shown on the website does not itself change an existing subscription.

AI drafting allowance

Your account includes a $3 allowance for AI-assisted drafting. When that allowance is exhausted, drafting pauses and the app directs you to support. We do not automatically charge your saved payment method for a drafting top-up.

Refunds and refinements

Payments are non-refundable, except where required by law. If you are dissatisfied with your first study, its fee can be applied as a credit toward a refinement run. This is a credit, not a cash refund or a guarantee of accuracy. Contact support@instasights.ai to request it.

A refinement covers minor changes to wording, quotas, or comparison groups and cannot change more than approximately 10% of the questionnaire. A substantially different questionnaire or research objective is a new study.

6. Suspension and termination

We may suspend or terminate access for misuse, nonpayment, or violations of these terms. Your right to access the Services ends on termination. Data retention and deletion are described in the Privacy Policy.

7. Disclaimers

The Services are provided “as is,” without express or implied warranties. To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages. Our total liability for a claim will not exceed the lesser of the fees you paid for the study giving rise to the claim or the total fees you paid in the twelve months preceding the claim.

9. Privacy and security

Our Privacy Policy, including its information about security and retention, forms part of these terms. It explains how account information, research material, and other data are handled.

10. Governing law and disputes

Illinois law governs these terms, without regard to conflict-of-law principles. Disputes will be resolved by binding arbitration under the rules of the American Arbitration Association in Chicago, Illinois. You waive the right to participate in class actions or representative proceedings.

11. Indemnification

You agree to indemnify, defend, and hold harmless the operating company and its officers, directors, employees, and agents against claims, damages, losses, costs, and expenses, including reasonable attorney fees, arising from your violation of these terms or third-party rights, content or data you provide or generate using the Services, or negligent or wrongful conduct.

12. Experimental features

Features labeled beta, experimental, or preview may contain errors and may be changed or removed without notice. They are provided as is, are not subject to the same service-level commitments as standard Services, and should not be used for production or critical business purposes.

13. Other provisions

We are not responsible for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, government action, telecommunications or power failures, and third-party provider failures.

The provisions concerning content and model rights, payments, disclaimers, liability, dispute resolution, and indemnification survive termination.

We may update these terms by posting a revised version here. Continued use after an update takes effect constitutes acceptance of the updated terms.
